A specific individual is one whose personal data is determined and processed in accordance with<br \/>\nfor the purposes specified by the operator. An identifiable individual is one who can be directly or<br \/>\nindirectly determine and process his personal data in accordance with the purposes set by the controller.<\/p>\n<h4>Individual<\/h4>\n<p>An individual is any natural person whose personal data is processed on a legal or contractual basis<br \/>\non the basis of the controller and that individual or on the basis of the explicit consent of the individual<br \/>\ngiven to the manager.<\/p>\n<h4>Upravljavec<\/h4>\n<p>Upravljavec dolo\u010da namene in sredstva obdelave v okviru svoje registrirane dejavnosti in\/ali zakonskih<br \/>\npooblastil. The individual is informed in advance who is the controller of personal data and who is<br \/>\nthe processor of his personal data.<\/p>\n<h4>Sub-processor<\/h4>\n<p>The sub-processor processes the personal data of individuals on behalf of and following the instructions of the processor, within<br \/>\nlawful purposes and methods of processing.<\/p>\n<h4>Processing<\/h4>\n<p>Processing of personal data means any act or series of acts carried out in relation to personal data<br \/>\nor sets of personal data with or without automated means, such as collection, recording, editing,<br \/>\nstructuring, storing, adapting or modifying, retrieving, inspecting, using, disclosing<br \/>\nmediating, disseminating or otherwise making available, adapting or combining,<br \/>\nrestriction, erasure or destruction.<\/p>\n<h4>Processing restriction<\/h4>\n<p>Restriction of processing means marking stored personal data in order to restrict their<br \/>\nprocessing in the future.<\/p>\n<h4>Profile design<\/h4>\n<p>Profiling design means any form of automated processing of personal data that involves<br \/>\nthe use of personal data to assess certain personal aspects of an individual, in particular for<br \/>\nanalysis or prediction of performance, economic situation, health, personal taste,<br \/>\ninterests, reliability, behavior, location or movement of that individual.<\/p>\n<h4>Pseudonymization<\/h4>\n<p>Pseudonymization means the processing of personal data in such a way that personal data without additional<br \/>\nthe information can no longer be attributed to the specific data subject,<br \/>\nprovided that such information is kept separate and subject to technical and organizational measures to ensure that<br \/>\nthat personal data is not attributed to a specific or identifiable individual.<\/p>\n<h4>Consent of the individual<\/h4>\n<p>The consent of the data subject means any voluntary, explicit,<br \/>\nan informed and unambiguous statement of the will of the data subject by which<br \/>\nexpress his consent to the processing of personal data relating to him by a declaration or a clear affirmative action<br \/>\nnanj.<\/p>\n<h4>Violation of personal data protection<\/h4>\n<p>Violation of personal data protection means a breach of security which results in intentional or unlawful destruction,<br \/>\nloss, alteration, unauthorized disclosure or access to personal data transmitted, stored<br \/>\nor otherwise processed.<\/p>\n<h3>PROCESSING OF PERSONAL DATA<\/h3>\n<h4>Processor data<\/h4>\n<p>Ale\u0161 Pesko, sobodajalec, A\u0161ker\u010deva ulica 8, 6310 Izola<\/p>\n<p>T: +386 (0)40 701 099 Ale\u0161<br \/>\nT: +386 (0)41 257 914 Matev\u017e<br \/>\nE: info@aryaisolana.si<\/p>\n<p>Podjetje je vpisano v Sodni register Republike Slovenije.<br \/>\nOdgovorna oseba za dajanje informacij v zvezi s tem aktom in varstvom osebnih podatkov je: Ale\u0161 Pesko, info@aryaisolana.si<\/p>\n<h4>Subprocessors<\/h4>\n<p>The processor has concluded contracts for the further processing of personal data of individuals of a particular<br \/>\nthe operator in cases where he has external processors in relation to the provision of his services in relation to<br \/>\noperator by its sub-processors. The processor is responsible for selecting subprocessors and takes care of that<br \/>\nare obliged to the same or higher level of protection of personal data as determined by Slovenian regulations and<br \/>\nEuropean Union regulations. The processor shall inform the controller of its existing processors and of<br \/>\neach time changing processors or hiring new processors. It does so by announcing the publication of new ones<br \/>\nconditions of privacy in which it lists new processors and gives the controller thirty days,<br \/>\nto rule on, approve or oppose changes.<\/p>\n<h4>Legal basis for the processing of personal data<\/h4>\n<p>The processor has a legal basis for processing the personal data of certain individuals<br \/>\nthe controller in a previously concluded contract between the controller and the processor or on the basis of another<br \/>\nservice contract agreement.<\/p>\n<p>The processor is responsible for ensuring that controllers are aware of this act and other acts of the processor,<br \/>\ninsofar as they regulate the field of personal data processing of individuals and \/ or business conditions for<br \/>\nimplementation of ordered services.<\/p>\n<p>The controller is responsible for providing the appropriate legal basis for the processing of personal data<br \/>\n(legitimate interest, contractual interest and \/ or explicit consent of the individual).<\/p>\n<h4>Types of personal data<\/h4>\n<p>The processor processes those personal data provided to it by the controller. The handler never<br \/>\nprocesses other personal data of individuals of a particular controller.<\/p>\n<h4>Purposes of personal data processing<\/h4>\n<p>The processor processes the personal data of the individuals of a particular controller only for the purposes for which<br \/>\nthe manager gave him instructions. The processor never processes the personal data of individuals<br \/>\ndesignated operator for other purposes.<\/p>\n<h4>The role of the manager<\/h4>\n<p>The controller is obliged to give the processor instructions for the processing of those personal data of individuals, s<br \/>\nwhich it manages. The controller must provide the processor with clear and unambiguous information on the type<br \/>\npersonal data and for what purposes it may be processed.<\/p>\n<h4>Documented operator instructions<\/h4>\n<p>According to this act, the controller is obliged to determine the processor and the duration of the processing of personal data,<br \/>\nthe nature and purpose of the processing, the types of personal data and the categories of individuals to whom it relates<br \/>\nrelating to personal data.<\/p>\n<p>The operator &#8216;s instructions must be documented and may be given in writing in plain or plain form<br \/>\nby e &#8211; mail, and in the case of oral instructions, the processor also requires written confirmation by ordinary or<br \/>\ne-mail.<\/p>\n<p>The processor is not responsible for the legality of the instructions it receives from the controller for processing personal<br \/>\ndata of individuals of a particular controller.<\/p>\n<h4>Confidentiality of data<\/h4>\n<p>The processor ensures that the persons authorized to process personal data are obliged to<br \/>\nconfidentiality or are bound by the relevant law. The processor has adopted internal Rules on<br \/>\nprotection of personal data and obtain a written commitment from all employees and external collaborators to<br \/>\nconfidentiality of data, acquaintance with the rules and appropriate security measures taken by the processor<br \/>\nimplemented to ensure an adequate level of data security.<\/p>\n<h4>Rights of individuals<\/h4>\n<p>The processor shall technically ensure that, under the direction of the controller and to the lawful extent, it provides support and<br \/>\ntechnical solutions and the final data that the manager needs when individuals are with the manager<br \/>\nexercise one or more of the rights conferred on them by law: the right of rectification, the right of erasure,<br \/>\nthe right to restrict processing, the right to data portability and the right to object.<\/p>\n<h4>Deletion or transfer of data<\/h4>\n<p>The processor deletes or returns everything based on previously documented instructions from the controller<br \/>\npersonal data to the controller after the completion of the service it provides for the controller and destroys existing copies,<br \/>\nexcept in cases where the storage of data is required by law.<\/p>\n<h4>Access to information<\/h4>\n<p>The processor shall provide the controller with all information necessary to demonstrate compliance<br \/>\nfrom this act and legislation, and to the controller or another auditor authorized by the controller<br \/>\nconducting and participating in audits, including reviews.<\/p>\n<h2><\/h2>\n<h3>SECURITY OF PERSONAL DATA PROCESSING<\/h3>\n<h4>Processing security<\/h4>\n<p>Processor and operator taking into account the latest technological developments and implementation costs<br \/>\nand the nature, extent, circumstances and purposes of the processing, as well as the risks to rights and freedoms<br \/>\nindividuals differing in probability and severity, controller and processor by implementation<br \/>\nappropriate technical and organizational measures to ensure an adequate level of security in relation to risk,<br \/>\nincluding, inter alia, measures covering:<\/p>\n<p>pseudonymization and encryption of personal data,<\/p>\n<p>the ability to ensure continued confidentiality and integrity, accessibility and resilience of systems and services for<br \/>\nprocessing,<\/p>\n<p>the ability to recover in a timely manner the availability of and access to personal data in the event of a physical or<br \/>\ntechnical incident,<\/p>\n<p>procedures for regular testing, evaluation and evaluation of the effectiveness of technical and organizational<br \/>\nmeasures to ensure the security of processing.<\/p>\n<p>In determining the appropriate level of security, particular account shall be taken of the risks posed by processing, in particular due to<br \/>\nunintentional or unlawful destruction, loss, alteration, unauthorized disclosure or access<br \/>\nto personal data sent, stored or otherwise processed.<\/p>\n<h4>Data Protection Officer<\/h4>\n<p>The processor is not obliged to appoint a person authorized to protect personal data because of the processing<br \/>\nit does not perform as a public authority or body, nor does it carry out the processing in which it would be<br \/>\nnecessary because of their nature, scope and \/ or intentions of the individuals to whom they relate personally<br \/>\ndata, regularly and systematically monitored extensively and does not cover the core business of the processor<br \/>\nextensive processing of specific types of personal data.<\/p>\n<h4>Security measures<\/h4>\n<p>The processor shall ensure appropriate security measures in the processing of personal data for the purpose of providing<br \/>\nprotection of personal data. Security measures are regularly monitored and updated in line with developments<br \/>\ntechnologies and legal requirements.<\/p>\n<p>The processor informs the operator about security measures and appropriate technical solutions separately<br \/>\na document which forms an integral part of these conditions of privacy governing the legal relationship between the controller and<br \/>\nprocessors and the Rules on Personal Data Protection, which regulate the legal relations between the processor and<br \/>\nemployees who process the personal data of individuals of a particular controller.<\/p>\n<h3>FINAL PROVISIONS<\/h3>\n<h4>Binding nature of legal conditions<\/h4>\n<p>1. The conditions of privacy apply to all controllers with whom the processor has regulated legal and business<br \/>\nrelationship by contract or in writing by e-mail and confirmed by the operators by e-mail<br \/>\nand it is considered that an annex to the existing legal relationship or a written annex to the<br \/>\nexisting written contract if requested by the operator.<br \/>\n2. The conditions of privacy shall be binding on all legal transactions concluded on the basis thereof.<br \/>\n3. The privacy conditions are an integral part of the service contract by the operator.<br \/>\n4. The operator confirms the acquaintance and agreement with these privacy conditions before ordering the service (v<br \/>\ncontract or in writing via electronic communication).<\/p>\n<h4>Changes to the Privacy Policy<\/h4>\n<p>1. The processor shall regularly update the privacy conditions with legal changes.<br \/>\n2. The processor shall notify the controller of changes in a timely manner in writing by electronic means<br \/>\nmessage.<br \/>\n4. The processor shall provide an archive of changes to the Privacy Policy to each controller<br \/>\navailable by prior written request to the contact e-mail address of the processor.<\/p>\n<h4>Conflict solving<\/h4>\n<p>The Processor and the Operator undertake to resolve any disagreements and disputes amicably and<br \/>\nby agreement.
